Overview

As the Commercial and Contracts Manager you will be responsible for supporting the development, management, and execution of the commercial management workplans and administration of the Project Agreement (PA) between the Owner and Project Contractor.


Accountabilities

  • Working closely with the Owner’s technical and construction management teams, leads the day-to-day administration of commercial terms within the contract between the Owner and Project Contractor.
  • Provides subject matter expertise related to commercial implications within the PA Agreement to the team when/if required.
  • Reviews, evaluates, and approves as appropriate the management of PA payment applications, change management, and Performance Incentive Management processes.
  • Supports in the management of contractual and ex-contractual claims.
  • Supports the management of disputes up to, including and after Expert Panel/Referee stage, including mediation, litigation & arbitration.
  • Assists in drafting of contractual correspondence; and liaises with legal when appropriate.
  • Undertakes assigned commercial tasks under guidance of the Commercial & Contracts Director.
  • Drafts contractual correspondence, as directed by the Commercial & Contracts Director.
  • Prepares and maintains commercial trackers (disputes, claims, changes, payments) and maintains commercial sections of project SharePoint site.
  • Prepares analysis of contractual claims, change valuations, as directed by the Commercial & Contracts Director.
  • Attends and contributes as appropriate to the Commercial Community of Practice.
  • Participates in the coordination of commercial lessons learned from projects for PA continuous improvement.
  • Supports and participates in training requirements for the Commercial and Contracts team.
  • Attends key design/construction meetings, both internal and external, as required.


Qualifications

  • Bachelor’s degree in quantity surveying, , civil engineering or construction management, or equivalent relevant experience.
  • 10+ years of progressive experience in the design, construction and contract administration of major infrastructure projects (preferably design-build transportation projects).
  • Experience with Provincial DB/DBF contracts within the Transportation sector would be considered an asset.
  • Strong relationship, communication, facilitation, negotiation, presentation, and interpersonal skills.
  • Thorough understanding of construction estimating, contractual, commercial, and financial functions on major projects.
  • Experienced negotiator of contracts, claims, and changes.
  • Claims management/dispute resolution experience on major projects.
  • Strong knowledge of contract language, change management, and legal requirements of contracts.
  • Experience developing and implementing strategies for risk and opportunity management.
  • Ability to liaise/co-ordinate internal and external legal counsel and experts.
